Can I show a commercially available film to my NMTAFE students?
Answer
Yes - Under section 28 of the Copyright Act, TAFE colleges are permitted to show a film or DVD as part of educational instruction, provided it is not-for-profit, the people in the audience are either giving or receiving instruction and are employed by or student of NMTAFE.
Section 28 also gives TAFE the ability to, for the purposes of teaching and instruction to:
- Stream YouTube Videos.
- Link to websites to display content.
- Play sound recordings from Spotify or another online music store.
However, you cannot format shift or copy the material. For example, you cannot save a movie to a hard drive or USB and then upload the film to Blackboard. You are also unable to download content and you cannot use illegal or pirated material.
