I have a student who is differently abled, and they need to access some materials in a different format. It is OK to format shift these materials?

Answer

Yes, section 113F of the Copyright Act, allows NMTAFE to make Accessible Format copies available for students with a disability, if the copyright materials are not commercially available in the format required ‘within a reasonable time and at an ordinary commercial price.’

Examples of accessible formats can include creating captions and adjusting image or text size and colour. A technological protection measure (TPM) may be circumvented for this purpose.

The following label and attribution should be included with the content copied under this exception:

Under this section, it is also acceptable to modify materials using AI tools to make them more accessible. Any materials that have been modified using AI should contain the following warning notice.

Finally, other options and devices are available through Accessibility and Learning Support, such as, special keyboards, reader pens and printing.
