As a TAFE lecturer am I able to scan a chapter of a textbook and post this chapter on Blackboard for the first two weeks of semester?

Under very limited circumstances only. The Statutory Text and Artistic Licence (section 113P) allows lecturers to copy textbooks where it 'does not prejudice the legitimate rights of the copyright owner.’ For example, if there is a textbook that has been ordered by students, but it will not arrive for 2 weeks, Lecturers are able to make copies of a chapter that is needed for students to use in class for the time that it is needed.
However, make sure that you:
- only use the material for educational purposes.
- limit access of the copied material to appropriate students/classes, no public access.
- not make a profit from using the work.
- only take what you need and make sure it is removed/inaccessible after you are done with it.

Make sure that any material that is copied under section 113P of the Copyright Act, has the following notice attached in the appropriate place.

This material has been copied [and communicated to you] in accordance with the statutory licence in section 113P of the Copyright Act. Any further reproduction or communication of this material by you may be the subject of copyright protection under the Act. Do not remove this notice.
